1. general
1.1 Scope. These General Terms and Conditions ("GTC") apply to all contractual relationships between Foundations Dance Collective OG ("Foundations Dance Collective") and its dance students ("Customers") and form an integral part of the respective contract with the Customer. Foundations Dance Collective offers its services according to point 2 exclusively under application of these GTC. The version of these GTC valid at the time of the conclusion of the contract is authoritative. Verbal side agreements lose their effect with the conclusion of the contract.
1.2 Posting of the GTC. The current version of the GTC is available on the homepage at www.foundationsdancecollective.com.
2. services
2.1 Scope of Services. Foundations Dance Collective offers dance workshops, dance events, competitive dance team and all related services. The current range of services is published on the website of Foundations Dance Collective. Prices listed include all taxes.
2.2 Range of services. The Customer has the possibility to purchase one-way tickets for one-off workshops, events, etc. and binding registration for competitive dance team, dance trips, weekly dance classes, etc.
2.3 Service Design. The service design, the service content and the service dates are determined by Foundations Dance Collective. The customers do not have any say in the matter. Also the choice of the studio and the dance teachers for the respective services are up to Foundations Dance Collective. The choice of music is up to the respective dance instructor; this may also include offensive song lyrics.
2.4 Changes. Foundations Dance Collective expressly reserves the right to change the services offered as well as the service content and service dates.
3. Payment Policy
3.1. Purchases. Once your bank transfer or online purchase was successful, your registration to one of our services is binding. It is not possible to attend one of our services without prior payment. The fee for participation must be paid via our website wwww.foundationsdancecollective.com.
4. Refund Policy
4.1 Refunds for workshops. Once you purchase a workshop ticket via www.foundationsdancecollective.com it is binding to the class you chose. If your cancellation takes place at least 48 hours prior to the start of your booked workshop, we are able to refund the amount paid via your used payment method. Afterwards, all workshop tickets are non-refundable and no class credit will be given.
4.2 Refunds for weekly classes. Drop ins, 10er blocks, semester registration, and yearly registration for weekly classes are non-refundable. No exceptions.
4.3 Refunds for other events. Refunds for other events, such as dance trips, dance conventions, etc. are outlined on the purchasing page for that specific event. Please refer to the purchasing page for that specific event for more information.
4.4 No shows. In case of a no show for any services provided by Foundations Dance Collective, no refunds will be given. 100% of your paid fee for the service will expire automatically and your spot may be given to someone else.
4.5 Gift cards and vouchers. Vouchers created and handed out by Foundations Dance Collective never expire. Gift cards are valid according to Austrian Law (Konsumentenschutz) and cannot be refunded.
4.6 Merchandise. As a small business, we encourage our customers to make thoughtful purchasing decisions to avoid unnecessary returns.
Thoughtful Purchasing: Please ensure you are confident in your choice of size, color, and style before making a purchase.
Right to Return: In accordance with consumer rights, you have the right to return or exchange goods within fourteen days without providing a reason. The withdrawal period is fourteen days from the day the goods were delivered to you.
Refund Process: The total purchase price (excluding shipping costs) will be refunded once the returned goods have arrived at our dance studio. Returns must be shipped at your own expense.

Final Sale Items: All sales of reduced or custom-made items are final. No refunds or exchanges will be provided for these items.

5. Copyright
5.1 Artistic copyright. The copyright belongs to Foundations Dance Collective and the respective dance teacher(s). The ideas, assets as well as choreographies learned in class or from a tutorial are meant for personal use only. Passing on copyrighted content or choreographies learned during class or tutorial to a third party is strictly prohibited.
5.2 Photo and video. All photo and/or video material that is produced as part of Foundations Dance Collective is the legal property of Foundations Dance Collective. Photo and video material from dance workshops and performances may be used indefinitely for internal purposes (design of the website, invitations, newsletters, etc.), for media presence (TV, print, online, social media) and advertising (printed matter, merchandise, etc.). The customer has no financial or legal rights to photo or video material of him/herself that was made in the classes. If the participant absolutely does not wish to be recognizable in photos or video material, you need to notify Foundations Dance Collective prior to the video or photos being made.
6. In the Studio
6.1 Risk. Dancing and training during our classes/services is at your own risk. Foundations Dance Collective does not take any responsibility for any accidents of our attendees or any emotional or physical damage that comes with it. Customers are responsible for their own actions and insurance that would cover the costs in case an accident happens. We do not assume liability for your own negligence. For minors (anyone under the age of 18), the parents assume liability. Also, please be cautious of slippery floors at any time. We do not assume liability for your wardrobe, personal valuables as well as any damages of property.
6.2. Customer health. With the registration to one of our offered services you automatically agree that you are physically and emotionally healthy or that you are able to meet the physical and emotional requirements of taking a dance class. The participation of any offered service under the influence of drugs, alcohol or pharmaceuticals is prohibited.
9. Limited Liability
9.1 Limitation of Liability. Foundations Dance Collective is not liable for personal injury or property damage not caused directly by Foundations Dance Collective and its workforce. The participation in dance workshops, events, team, etc. is at your own risk. In case of claims for damages against Foundations Dance Collective, Foundations Dance Collective reserves the right to be excluded from liability.
9.2. Valuables. Foundations Dance Collective is not liable for unattended objects of any kind.
10. data protection
10.1 General. Customer data is processed exclusively in accordance with the General Data Protection Regulation ("DSGVO") and the relevant national data protection regulations.
10.2 Privacy Policy. For more information, please refer to Foundations Dance Collective's Privacy Policy.
11. final provisions
11.1 Changes of the GTC. Foundations Dance Collective reserves the right to make changes of these GTC.
11.2 Applicable Law. These GTC shall be governed by Austrian law, excluding the conflict of laws rules.
11.3 Place of Jurisdiction. The place of jurisdiction for all disputes arising out of or in connection with Foundations Dance Collective, as long as such a place of jurisdiction is permissible, is the court in Graz which has jurisdiction over the subject matter and location.
11.4 Online Dispute Resolution. The EU Commission provides a platform for online dispute resolution on the internet under the following link: https://ec.europa.eu/consumers/odr. This platform serves as a contact point for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer. However, Foundations Dance Collective is not willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board to resolve disputes with consumers.
11.5 Severability Clause. Should any provision of these GTC be or become invalid or unenforceable, the legal validity of the remaining provisions shall not be affected. In place of the invalid or unenforceable provision, a valid and enforceable provision that comes as close as possible to the original intent of the parties shall be deemed agreed.
